The following description was prepared by William Gross:
This contract was made soon after the wedding to ensure that if the husband would die without children, his brother would perform Chalitza and his wife would be free to marry as she chose. The brother of the husband guarantees that if he refuses to do Chalitza for his sister-in-law he will be obligated to pay her a large sum of money. In order to guarantee this contract, the husband’s brother “admits” in the document that he received this sum of money as a loan from his sister-in-law. If he refuses to do Chalitza he will be obligated to repay the loan. He will only be exempted from the loan when he does Chalitza.
Another way of assuring Chalitza appears on the Shtar Bitachon Chalitza (see GFC 034.011.015).
Rabbi Yaakov Moshe Levenstam was the Rabbi of the community at the time. These contracts were issued under his guidance.
